Probate: a COVID-19 update

Some of you may be wondering how the current crisis is affecting Probate.
Here’s what we know:
- There may be some delay in the issue of Grants of Probate for the foreseeable future as no face to face meeting are taking place at Probate Registries. And staff numbers will be depleted due to those in self isolation because of being symptomatic or in high risk groups.
- We’re still waiting for the Government to issue guidelines on the signing and witnessing of wills during this lockdown period.
- New legislation allows deaths to be registered over the telephone without the need for the register to be physically signed and there are also new rules relating to legal requirements around cremations and inquests.
- The legislation, establishing the new requirements, is initially in place for the next two years, but as Covid-19 provisions are changing rapidly, please keep an eye on our website for further updates.
